Human Rights of People living with HIV and AIDS |

To commemorate World AIDS Day 2009 and as part of the Northern Cape Business Sector Strategy on HIV and
AIDS, SABCOHA seeks to remind people of some of their rights and resultant obligations. SABCOHA also seeks to
strengthen cooperation within and across the business sector to improve support for all people living with HIV and AIDS.
There are three key laws and a code of good practice that address the Human Rights of People living with HIV and AIDS:
- Constitution
- Labour Relations Act
- Employment Equity Act
- Code of Good Practice on HIV/AIDS and employment
These laws and policies prohibit discrimination, protect privacy and confidentiality and, promote fairness
in employment practices. The Code of Good Practice further encourages employers to develop workplace policies
and programmes that not only promote these rights but also provide prevention,
wellness and care and support services to employees.
